Introduction: Notarization can also be referred as “notarial acts”. There are three elements in this act – these are vetting, certifying and record keeping. Notarization is required to prevent fraud and assure the authenticity of any documents. Notary services online and offline both are popular. Here will discuss about different types of notarial acts. 

There are different types of notarial acts-

Acknowledgements – Acknowledgements are necessary for document of valuable assets like deeds, mortgages.

An acknowledgement assures that the document has voluntarily signed by the signer. And, purposely he has to be present in person at the court during the notarization procedure.

Jurats – To ensure the truth of the documents, the signer has to sign a jurat. For, this purpose he/she has to present before the court in person. This process is required to confirms the contents of the documents to be true.

Oath and affirmation – The verbal oath or affirmation is also very important to prove the truthfulness of a client. Both of these activities are to be done orally. Therefore, even if anyone is preferring notary services online, yet, this process need to be done while present physically.

Copy certification – Copy certifications are required by documents like diploma, driving license, medical records, bills of sales. A copy certification is required to confirm the originality of any document.

Although all these activities are required a mandatory physical presence of the signer and the notary public. Therefore, notary services online cannot fulfil those criteria. There are many other benefits of online notary services, like –

  • Because the entire process is online based, so it is done by a secure electronic key e.g. – PDF signature or any other software. In that case, the final document may not look same as the offline document. Therefore, it may happen that the client refuses to accept the virtual signed documents.
  • Along with the online platform, the client should have a scanner, otherwise, documents cannot be uploaded. Because, digital copy of the documents is required to be notarized.
  • Online safety is a big question. There can be chances of data theft if the process is not fully encrypted. Therefore, good software or data security tools to be used in the system.

Conclusion: There are offline services available till date. It is not like that entire procedure has become notary services online, only. Yet, online is the crazy platform to all.
